The Legal Sector Code represents a critical step toward transformation in South Africa’s legal profession, aligning with the BBBEE Act to drive inclusivity and growth. However, while the requirement for BEE Rating Agencies to be accredited is not new, the introduction of this sector-specific code is expected to create significant bottlenecks.

SANAS (South African National Accreditation System), which is responsible for accrediting agencies across various sectors, will now face an influx of applications from agencies seeking compliance with the BBBEE requirements under the Legal Sector Code. This volume could lead to delays in accreditation, slowing down the issuance of certificates and potentially creating a backlog in the industry as agencies vie for approval in this new area.

Beyond the administrative bottlenecks, the Legal Sector Code introduces distinct challenges for the legal profession itself. Unlike other sectors, the legal industry is uniquely positioned to scrutinise and potentially contest the Code, especially since its strength lies in interpreting laws. The Code’s reference to different qualification levels remains vaguely defined, allowing room for ambiguity and various interpretations. This lack of clarity may complicate compliance for legal professionals and spark debates within the sector.

As we move forward, the legal sector will undoubtedly grapple with these challenges, and it wouldn’t be surprising to see the profession itself lead the way in challenging these very BBBEE compliance measures.
